Chter 1. General Provisions and Acceptance
Article 1 (Purpose and Effect) These Terms of Service (the “Terms”) govern the conditions and procedures for using the services of kculture.com (the “Site”) and define the rights, obligations, and responsibilities between the Site and its users. By accessing or using the services provided by the Site, the user shall be deemed to have accepted and agreed to these Terms.
Article 2 (Modification of Terms) The Site reserves the right to modify these Terms when a reasonable cause arises. Any changes shall be notified via public announcement on the Site. Users who disagree with the revised Terms may cease using the service.
Chapter 2. Membership and Service Access
Article 3 (Membership and Exclusive Registration)
- Access to the Site’s interactive features (including commenting and future forum use) is granted exclusively through Social Login.
- The Site does not offer a separate, direct user registration process (e.g., username and password setup).
- By logging in via a third-party social media provider (e.g., Google, Facebook), the user agrees to the creation of a corresponding subscriber account on the Site.
Article 4 (Account Management and User Responsibility)
- Users are responsible for maintaining the security of their connected Social Login account credentials.
- The Site is not liable for any damages, losses, or security breaches resulting from the user’s failure to maintain the security of their Social Login account or its related social media platform.
Chapter 3. User Content (Comments and Forum Posts)
Article 5 (Definition and Ownership of User Content)
- User Content refers to all information posted or transmitted by the user on the Site, including comments and future forum posts.
- The intellectual property rights to User Content belong to the user who created the content.
Article 6 (Control and Disclaimer related to Social Login)
- User Content Control: The user’s ability to edit, modify, or delete their User Content is directly contingent upon the user maintaining an active and functioning connection via their Social Login account with the Site.
- Disclaimer of Responsibility: The Site disclaims any responsibility or liability for a user’s inability to control, modify, or delete their User Content should the user:
- Lose access to the linked social media account.
- Disconnect or revoke the Site’s access permissions from the social media provider.
- Encounter technical issues with the social media provider that prevent login or account authentication.
- The Site is not obligated to manually fulfill user requests to control or delete content posted while the Social Login connection was active, particularly if the connection has been lost.
Article 7 (License for User Content) By posting User Content on the Site, the user grants the Site a permanent, non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute the content for the purposes of operating, promoting, and improving the service, and for developing new services.
Chapter 4. Prohibited Acts and Service Interruption
Article 8 (Prohibited User Acts) Users shall not engage in the following acts while using the service:
- Impersonating another person or fraudulently using another person’s information.
- Defaming or slandering others, or spreading false information.
- Posting or disseminating obscene, violent, or other information that violates applicable laws.
- Interfering with the stable operation of the Site or preventing other users from using the service (including spamming or distributing malicious code).
Article 9 (Termination of Service) The Site may temporarily restrict or permanently terminate the service agreement if the user violates any provisions of this Chapter or other sections of the Terms.
Chapter 5. Indemnification and Miscellaneous
Article 10 (Indemnification)
- The Site is exempted from liability for service provision when service becomes unavailable due to natural disasters or force majeure events equivalent thereto.
- The Site is not responsible for any damages resulting from the user’s use of information or materials obtained through the service.
Article 11 (Governing Law and Jurisdiction)
- The laws of the Republic of Korea shall govern the interpretation of these Terms and any disputes between the Site and the user.
- Any legal action arising from the use of the service shall be brought before the competent court under the Korean Civil Procedure Act.
